Only if they have been Deputized which more in likely they are! I know County Sheriffs will Deputize Local Police so they can go outside of the City Limits.

Bottom line,

I always cooperate with all Law Enforcement Officers, it may be beneficial to my health!

Game wardens have more power than any other LEO. Along with being a commissioned officer, with full powers of arrest for any violation, game wardens have the right to enter a residence without a search warrant if reasonable suspicion of a game law violation exists. That being said, the game wardens of several states did more rescue work and law enforcement function than any other agency in the aftermath of Hurricane Katrina, because they had the boats, 4X4s, powers of enforcement, weapons, and training to deal with the situation.

crm3006 is correct.

In PA, game commissioners have more authority the the State Police.

If they have a reasonable suspicion they can enter your home and search it, without a warrant.

The entry is now debatable and has been tossed out of Court on the 4th and 5th Amendment!

4th-
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
====================================================

5th-

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Clay Cooper-
Game wardens in TX and OK are commissioned by the state, just like the Highway Patrol (OK) and the DPS (TX). The last time I checked, they still had the right to enter either a residence, or private property, without a warrant, on reasonable suspicion, ie, a reliable tip, observing an illegal act, surveillance, tailing a suspected violator.
On another note, how can I reach you by E-mail?

they can pull you over for traffic violations. A few months ago in northern WI the Game warden responed to a bank robbery. He caught up with the getaway car. Started chasing it~car stopped door flew open and open fire on the warden. Took off the chase started again a little while later a county cop pitted him. The cop and warden were under fire~they both fire back killing the suspect. So they have all the power they want!!

To my knowledge, a game warden can still enter your home with nothing but suspicion of a violation, here in Maine.

That's always been a wild card and be interesting how it would play out in the Supreme Court

Drugs or game, does one take precedence over the 4th Amendment than the other one?

In addition to what crm 3006 and others stated, in Wyoming game wardens can also search your hunting or fishing camp, pack horses, or vehicles whether parked or traveling down the road as long as they have probable cause. Ultimately more authority than sheriffs, state police, and U S marchals insofar as ability to search and make arrests. Its always good to be friends with them.

As I see it, Game and Fish hasn't got the same spotlight as other criminal cases have concerning the 4th and 5th Amendment and because of it hasn't come under the scrutiny of it. Just because they are Game and Fish, doesn't give them immunity of the constitution.

The Constitution instructs and tells the Government what it can and cannot do, not the people!

crm06,
Yep, in Missouri they are peace officers and there is not a bit of land or water they can't go. They have more authority than the state highway patrol.

I don't know about all that Treestand?
(Not just Air Port) Customs and Border Protection Agents, are Feds. They are all under the same hat, the hats are just different colors! (Customs-blue Border Protection-green) The CBP has wide ranging authority but has a very narrow concentration!
As far as the "search" thing goes, I don't know, but I do know that the CBP agents along the border can disassemble a suspicious vehicle without a warrant! Kinda hard to find a house trying to cross the border! LOL!!

They do have more authority than any other LEO, but at least here in Ohio they usually don't practice it to often because of the risk. To many people view them wrongly and several have been shot or shot at. Last year the Shelby County DNR officer was shot at 5 seperate times and luckily was able to prosecute all incidents.

Yes it is good to have a civil relationship with your local DNR officer. My friends and I do with our local DNR officer for 2 reasons, She is hot, and she now won't walk into the woods on us anymore as long as she sees one of our trucks parked outside the woods. She will wait to talk with us, which isn't really all that bad!
