Idaho first to sign law aimed at health care plan

BOISE, Idaho — Idaho took the lead in a growing, nationwide fight against health care overhaul Wednesday when its governor became the first to sign a measure requiring the state attorney general to sue the federal government if residents are forced to buy health insurance.
Similar legislation is pending in 37 other states.
Constitutional law experts say the movement is mostly symbolic because federal laws supersede those of the states.
But the state measures reflect a growing frustration with President President Barack Obama's health care overhaul. The proposal would cover some 30 million uninsured people, end insurance practices such as denying coverage to those with pre-existing conditions, require almost all Americans to get coverage by law, and try to slow the cost of medical care nationwide.
Democratic leaders hope to vote on it this weekend.
With Washington closing in on a deal in the months-long battle over health care overhaul, Republican state lawmakers opposed to the measure are stepping up opposition.
Otter, a Republican, said he believes any future lawsuit from Idaho has a legitimate shot of winning, despite what the naysayers say.
"The ivory tower folks will tell you, 'No, they're not going anywhere,' " he told reporters. "But I'll tell you what, you get 36 states, that's a critical mass. That's a constitutional mass."
Last week, Virginia legislators passed a measure similar to Idaho's new law, but Otter was the first state chief executive to sign such a bill, according to the American Legislative Exchange Council, which created model legislation for Idaho and other states. The Washington, D.C.,-based nonprofit group promotes limited government.
"Congress is planning to force an unconstitutional mandate on the states," said Herrera, the group's health task force director.
Otter already warned U.S. House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid in December that Idaho was considering litigation. He signed the bill during his first public ceremony of the 2010 Legislature.
"What the Idaho Health Freedom Act says is that the citizens of our state won't be subject to another federal mandate or turn over another part of their life to government control," Otter said.
Minority Democrats in Idaho who opposed the bill called the lawsuits frivolous.
Senate Minority Leader Kate Kelly, D-Boise, also complained about the bill's possible price tag. Those who drafted the new law say enforcement may require an additional Idaho deputy attorney general with an annual salary of $100,000 a year.
Kelly said that was irresponsible when Idaho is grappling with a $200 million budget hole.
"For Democrats in the Legislature, our priority is jobs," she said. "We'd rather Gov. Otter was holding a signing ceremony for (a jobs package) meant to put Idaho residents back to work."

The frightening thing to me is people like you. You seem to be well educated, you write well and I enjoy reading what you write but it truly frighten me that there are obviously people like you that simply want to blow off the weight of this horrible proposal. We can't pay for this. We're broke as we speak. Where does the money come from. Maybe we can sell off some more of our country? You want us to add more social programs but the ones we are suffering with now are all disasters and lead to nothing but more of the same. Everyone that actually has a job and works for a living will be placed under such new burdens that many will throw up their hands and give up. I belong to a small business association and if the information that we receive is correct 30% of us will no longer be able to provide what is required under proposed federal guidelines. The economy is already so bad here that I may have to let 4 of my employees go, two with large families to feed. How does placing additional financial burden on me with this health care plan help the economy?
The real problem with this administration is that they have never had jobs. They only know what looks good on paper. The human suffering is never a consideration. They say I can help that poor family if I only do this one thing--but that one thing will affect the lives of four hard working people that may lose their jobs as a result.
America has a population of 300-310 million people, This healthcare bill is expected to cost 900-950 billion dollars to cover 30 million people. I bet it ends up costing well over that much. it is like a bad infomercial 19.95 plus shipping and handling, then shipping and handling costs another 19.99. 30 million people, that is 10% of the population..oddly enough we are sitting at about 10% unemployment...This bill is putting us right in step with Germany and other socialist countries. I am also interested to see how it will be "voted" on Why don't they just recycle the constitution into toillet paper while they are at it. Piece by peice step by step. If you lost all freedoms over night you would fight till the death. Lose them a little at a time by a thief in the night when you WAKE UP you have no freedom and no fight

It will be another bomb run by the goverment that is already broke.It can not be a positve experiance for most americans already struggling financialy. Small bissiness is the back bone of our country and it is the wish of the Obama administration to break
there backs. To have all americans dependant on the goverment
for every thing. Once this is in place the present administration will declare amnesty for all illeagle imigrants
to garner more votes in the next election. From there they will go after all the guns as armed citizens cannot fight back.

Actually, a Senator or Representative votes according to what in their best judgement will be in the best interests of their district, state, and nation. I really don't want my elected officials to be voting only according to what the polls indicate, nor according to what the strict party party line is. I expect who ever is representing me to be using their brain, their best judgement in deciding how they will vote. If I don't agree with the majority of their votes and if I don't trust their judgement then I'll work to get someone else elected next time around. If we really don't want a thinking person representing us, then we ought to get rid of this system, and once a day we could go to our computers and vote on each specific issue, kind of like the rediculous video polls that the networks do daily on the issues, but really have no validity.

1. You credit a Senator or Representative with having "best judgment." Their "judgment" seems to be based on the opinions of lobby pests, and what kind of a sweetheart deal they can cut for themselves. This has gone on for far too long.
2. You credit said representatives with having a brain, when the existence of Harry Reid, Barney Frank, John Kerry, Dennis Kuchinich, Nancy Pelosi, Henry Waxman, Barbara Boxer, Dianne Feinstein, Chris Dodd, Sheila Jackson Lee, ad nauseum, contradicts this.
As a group, the U.S. Congress is the most corrupt, venal and low life bunch of pond scum ever collected in any one location. If anyone with any common sense was passing laws, they would put a bounty on Congress!
As I said, I expect our Senators and Representatives to use their best judgement. If I am dissatisfied with the results, then I'll use the system that put them in office and do my best to get someone I trust in office.
You are correct 3006, lobbiests have way too much influence, and that is an extreem understatement. Now, corporations have the constitutional rights of individuals. That all needs to be repealed. We need a country where the people are sovereign, not the corporations. The biggest threat to our individual rights is not the democratic or republican party, but the corporate strangle hold on our media and every level of government.

Just previous to this, I thought I laid out a very good case for no common sense in Congress. And, yes, according to the current regime, I am a gun owner, veteran, TEA party supporter, and read my Bible. I qualify as a "terrorist."
Dan misses one important point, which is the big base of all the anger right now.
Yes, the system that elected someone can remove them. However, there is a time during which they are in power, and can destroy everything in that time.
If a person says "If you elect me, I will vote against Bill-X.", and you vote for them, and they vote for it, because the party says to, that is both a lie, and a slap in the face for the (possibly millions) of people who voted for them. They have a blank check as long as he can stay in office.
It's the "answering to no one" of their own electorate that is making people mad.

And, I’m a big believer in ongoing political action calling attention to specific issues, and sustained respectful dialogue with our Reps’ and Sens’ offices on those issues. But, do our representatives really have their ears to the ground listening to our needs, or instead to the demands of their corporate sponsors. So, I’ll correct what I said above. So, Jeff, who specifically is not being responsive that has gotten your ire up?

The absolute truth is ObamaCare will be a massive, and I mean massive, debt ridden, corruption ridden policy that will drive us over the top, into BK...we may end up there anyway. Fraud is incredible in the far smaller, Medicare portion, and they will not do anything about it! Democrats do not want this bill debated as they just nixed the open debate, and financial numbers that have come out from the budget office. It would be further doom for them in November.
