I think the point of trying them in criminal court instead of a military tribunal is to give the image of due process, or somesuch. Doesn't seem necessary at this point, the main mastermind already plead guilty in military tribunal and asked for the death penalty. My only worry is that the trial will get railroaded like some do, with a mistrial on a technicality. Can you even imagine?
