Heroes of Conservation Contest
The Heroes of Conservation Contest (the “Contest”) is sponsored by Field & Stream magazine, a publication of Bonnier Corporation (“Sponsor”).
ELIGIBILTY: The Contest is open to legal residents of the continental United States (excluding Hawaii) and the District of Columbia. Entrants must be 21 years of age at the time of Entry and must have a valid, government issued driver’s license. Employees of Bonnier Corporation and Toyota Motor Sales, U.S.A., and their parent companies, subsidiaries or agents, their immediate families (defined as parents, children, siblings, spouse and grandparents), and those domiciled with any of the foregoing are not eligible. All void where prohibited or restricted by law. This contest is conducted in compliance with all applicable federal, state, and local laws.
ENTRY: Eligible participants in the Contest can either nominate themselves or another eligible person or group, but eligibility requirements apply to both the nominating party ("Nominator") and the party nominated ("Nominee"). The word "Entrant" used herein refers (unless otherwise stated) to both the Nominator and the Nominee, and the word "Entry" used herein refers (unless otherwise stated) to both the nomination by the Nominator and the participation in the Contest by the Nominee.
Nominees will be given the opportunity to accept or decline their nomination; if they decline, they will become ineligible to participate in the Contest or win, but, if they accept, they shall be subject to all of these Official Rules and will be deemed "Entrants" hereunder and their participation deemed an "Entry."
To enter, submit an entry form electronically. To enter, visit our website at www.fieldandstream.com/heroes. All information provided by Entrant must be complete, true and correct. Online nomination forms must be received by 11:59 pm Eastern Time on May 31, 2013 in order to be eligible; entries received after that date will be deemed ineligible to win. All submitted entries become the property of Sponsor and will not be acknowledged or returned; Sponsor is not responsible for lost, late, inaccurate, incomplete, damaged, illegible, or misdirected entries. Each entry must be submitted on an individual basis (i.e., no team, joint, or corporate entries) and all components of the entry must be the original creation of the submitting participant. Only non-commercial work may be submitted. Entries may not contain profanity, nudity, pornographic images, violent images, anti-competition messages, illegal material, or material that violates the rights of third parties. Entries may not include confidential information, trade secrets, trademarks or copyrighted material belonging to any person or entity other than the entrant absent a suitable license or permission agreement, proof of which is required. Entries containing any forbidden matter or material otherwise deemed by Sponsor to be inappropriate will be disqualified. Online entries will be deemed submitted by the authorized account holder of the email address submitted at time of entry. One entry per person; multiple entries will be disqualified. No telephone calls, please.
JUDGING: A panel of judges consisting of Field & Stream editors and conservation leaders ("Judges") will select six (6) Nominees to be finalists (the “Finalists”) from the entrants’ pool of submitted entries based on each Nominee's commitment, how much the Nominee's project has grown, and its results. Persons otherwise eligible to be Nominees who were included in the Heroes of Conservation Column in Field & Stream magazine since the February 2005 issue and through the August 2013 issue (herein referred to as "Magazine Nominees") or persons otherwise eligible to be Nominees who led qualifying Hero for a Day volunteer workdays in fall of 2012 through the spring of 2013 (who are also "Nominees" hereunder unless otherwise stated), are eligible to win the Grand Prize or runner-up cash prizes whether or not they are separately nominated by a Nominator. Judges' decisions are final. The Finalists will be notified by phone or email on or before June 3, 2013. Sponsor reserves the right not to select any winning submissions based upon the quantity or content of submissions. One Grand Prize Nominee (“Hero of the Year”), chosen from the Finalists will be announced at the 2013 Heroes of Conservation Gala in September, 2013. The Finalists and Hero of the Year must sign affidavits of eligibility and privacy/publicity releases (except where restricted by law) for Field & Stream and Toyota and releases of any liability against Field & Stream, Toyota and their affiliates. All affidavits and releases must be returned to Field & Stream within seven (7) business days of notification attempt, or if notification is returned as undeliverable, an alternate Finalist(s) will be selected.
PRIZE AWARDS: The grand prize ("Grand Prize") awarded to the Hero of the Year will be a new Toyota Tundra, Approximate Retail Value: $35,000. The depiction of the Grand Prize vehicle in any advertising or promotional materials may not reflect the actual vehicle delivered to the Hero of the Year. A cash prize of $5,000 will be awarded to each of the Finalists, including the Hero of the Year. A cash prize of $500 will be awarded to all Magazine Nominees whether or not they are separately nominated by a Nominator, and in addition to any other prize they might win in the Contest.
The Finalists will film two webisodes with a Field & Stream representative and Warren Miller Film crew. The Finalists will also participate in a photo shoot for a feature in Field & Stream magazine. The Finalists will be sent to the Heroes of Conservation Gala in Washington, D.C. in September 2013. During the Gala, each of the Finalists will receive a two-night stay in a Washington, D.C. hotel (room and tax only) chosen by Sponsor, one round-trip ticket to/from a Washington, D.C. airport and closest airport to Finalist’s place of residence. If a Finalist drives to Washington, D.C., Sponsor will reimburse Finalist for gas and tolls while driving directly to/from Washington, D.C. hotel and place of residence, and hotel parking for two nights. The Finalists are responsible for airline luggage fees and other airline related expenses (such as food and beverage), and transportation to/from hotel and the airport.
All federal, state and local laws and regulations apply; void where prohibited. PRIZES MAY BE SUBJECT TO TAX; ALL APPLICABLE TAXES ARE THE RESPONSIBILITY OF THE WINNER. The Hero of the Year shall be responsible for all license, title, and registration fees or other costs, including without limitation any travel or transportation costs associated with transferring and/or winning of the Grand Prize vehicle (provided, however, the Grand Prize vehicle shall be delivered at no cost to the Hero of the Year at an authorized Toyota dealer or distributor in the continental U.S. within reasonable proximity to the Hero of the Year’s residence). The Grand Prize is non-transferable and cannot be substituted (except that Field & Stream reserves the right to substitute prizes of equal or greater value).
Entry and acceptance of prizes by the Finalists constitute permission to Field & Stream, Toyota and their designees to use the name, address, testimonial, hometown, project description, and photos/images of the winners and photo subjects for publication, advertising, and promotion throughout the world in all media, now or hereafter known in perpetuity, without further compensation.
The Grand Prize vehicle will only be delivered in the continental United States. Field & Stream and Toyota will not be responsible for delays in delivery of the Grand Prize vehicle, and delivery is subject to availability. Toyota, however, will use all reasonable efforts, subject to availability, to deliver the Grand Prize vehicle within one hundred twenty (120) days after receipt of the aforementioned items/information from the Hero of the Year. The Hero of the Year shall bear all risk of loss or damage to the Grand Prize vehicle after it has been delivered to the specified delivery site. The Hero of the Year must personally retrieve the Grand Prize vehicle within thirty (30) days of written notification of delivery and must present adequate personal identification and evidence of legally required insurance (or an alternative Finalist shall be selected and the original Hero of the Year's rights to the Grand Prize vehicle shall be automatically forfeited).
The Grand Prize vehicle will be delivered solely with the express written limited warranties set forth in the Grand Prize vehicle's applicable Owner's Guide, which warranties shall run for the term set forth in said Guide.
GENERAL RULES & LIMITATIONS: By entering, you represent that: (i) your entry is your own original work; and (ii) you own or have the rights to convey any and all right and title in any material submitted as part of your entry into the Contest. By entering, you grant to Sponsor and Toyota a non-exclusive, worldwide, royalty-free license to edit, publish, promote, republish at any time in the future and otherwise use your submission, along with your name and likeness, in any and all media for any purpose, without further permission, notice or compensation (except where prohibited by law). By participating in the Contest, you agree to release Sponsor and Toyota and their parent companies, affiliates, subsidiaries, employees, directors, officers, and agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use, or misuse of any prize. Sponsor and Toyota are not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Contest, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes, in any Contest-related materials, or that may limit prize fulfillment or a participant's ability to enter the Contest. Sponsor and Toyota reserve the right to amend these official rules and to disqualify permanently from the Contest any person it believes has intentionally violated these official rules.
All materials submitted become the sole property of Field & Stream and will not be returned. Field & Stream, Toyota and each of their advertising agencies, and any of the aforementioned entities' parents, subsidiaries, operating divisions, and affiliates, will not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the prizes provided pursuant to the Contest and/or any person's participation in the Contest; provided, however, that Toyota shall be solely responsible for any express written limited warranties specifically set forth in the applicable Owner's Guide for the Grand Prize vehicle. By accepting any prizes, the Finalists agree to hold Field & Stream, Toyota, and each of their respective parents, affiliates, subsidiaries, and their respective directors, officers, employees, and assigns harmless against any and all claims and liability arising out of use of prizes.
PRIVACY: By entering, you agree that the information you provide may be sent to promotional partners of the Sponsor. You may be contacted by the Sponsor and/or promotional partners with future promotional offers. Information provided by you to participate in this Contest is subject to the privacy policies of the Sponsor.
