Illegal ATV Trail Costs Montana Man Over $25K
From the Billings Gazette:
Building an illegal trail and clearing trees in the Gallatin National Forest will cost a Livingston man five months in federal prison, a fine and $25,000 restitution. . . .
Forest Service officials determined that [Francis Leroy] McLain built a 6-foot wide ATV trail that was a mile and a half long. Agency officials estimated it would cost about $7,600 to dispose of downed trees that McLain had piled up and $25,948 to restore the land and prevent erosion.

$20 says we'll be reading about a poacher being fined for shooting a trophy buck on that strip once the new growth comes in.
Ya'know, they go after people like that but they will not go after the real culprits THE LOGGERS!
And that poacher will be fined $2,000 and 14 hours of community service.
Glad they caught this sucker, its people like him that give all ATV riders a bad name.
and if it is costing $33,000+ to fix this problem why is he only being nailed with $25,000 in restitution. nail him to the wall.

We keep our trail system open every year in the U.P. the forest service tried to tell us we were disturbing the forest right up until we showed them the trails we keep open are old logging trails from the 50's. Then it was amazingly OK.
I'll give him this, making an ATV trail in a National Forest definitely takes some balls! Dumb as hell, but ballsy no less. $30 grand in damages? Sounds like he was 'made an example of" to me.
wow 30k is a lot of money, i agree looks like an example. but still a hefty fine, especially when other, worse crimes are committed, and not even half that fine would be required.
I think there is more to that story that we are not privvy to.

One more quadhole bites the dust.
He may have just been keeping clear a trail that was already established, but was not on the states off highway vehicle plan. There is definately more to the story than is being reported. Looks like F&S should send someone to investigate this. The forestry people will not do anything except let it grow back up. The downed trees are habitat for small animals and insects.
This guy probably needs a strong united voice to back him up, go help him F&S.
You know dam well the forest service is going to do nothing with that area other than collect the money and waste it on protecting a leaf of some sort. Its funny we will put someone in prison for this, but drug dealers and murders roam the streets everyday! Another fine job by the justice system! Well maybe they will drill in that area for oil/gas!
They'll probably use the trail as a fire-break or an access road now and they've saved the money building it themselves PLUS whacked the guy beaucoup bucks also. You just can't trust government...
I was in montana fishing with my dad two summers ago and the atv trails in places they wernt supossed to be were a big problem

Sounds like F&S is siding with the state and not looking into it further. Was this a endangered area or just a flat game trail that was used to a further extent for a atv, I don't think the state will spend a dime on it either.
