Hurteau: Feds Drop “Deer Commander” Case After Supreme Court Ruling

Last week, the Supreme court struck down the Depictions of Animal Cruelty Act, a law that too-broadly prohibited trafficking in materials that depicts living animals being “intentionally maimed, mutilated, tortured, wounded, or killed.” (See previous coverage.) The ruling prevents antis from citing the law to attack hunting shows. And that’s great. But it has also forced federal officials to drop their case against the now-famous “Deer Commander.”

From an AP story via the First Amendment Center:

The U.S. Supreme Court ruling in United States v. Stevens has forced federal prosecutors to drop charges against an Illinois man who sold videos of himself running over deer with his reinforced pickup truck….

The St. Louis Post-Dispatch reported that [Jarrod] Hayn, a former Illinois Department of Corrections officer, boasted on the video "Deer Commander: Sudden Impact" that he had killed more than 300 deer with his 1985 Dodge Ram….

Though the high court's ruling noted there are state laws against animal cruelty, Missouri officials say there's nothing they can do to Hayn because investigators don't know when the killings happened.

Officials said most of the kills happened in Illinois, which has a one-year statute of limitations for the deliberate taking of deer with a vehicle….

Hayn's attorney, Ed Fanning, said even though charges against his client have been dismissed, that doesn't mean Hayn is walking away unscathed.

"His family's been devastated financially as a result of this," Fanning told the Post-Dispatch.

Fanning said people were taking Hayn's video out of context, but that the situation was partially Hayn's fault. Claims that he had more than 300 kills are "a total, absolute fabrication," he said.

"It's all theatrics to try and sell these videos," Fanning said. "I think he's made himself out to be a monster."

We can blame the Anti's for guys like Hayn getting away free. If they did not try to undermine legitimate hunters by hiding wording in the bill affecting legal activity then the bill may have passed protecting deer from guys like Hayn.

Could you be more specific about which bill you are referring to.I may have missed that link.
Cruelty aside there are many ways to take a animal , but to purposefully take a deer with a motor vehicle is careless and reckless.They should at least look to take his driving priveleges.

The videos should be prima facie evidence to convit the man in his home state of wanton waste of wildlife and killing deer utilizing illegal methods.

Using illegal methods of taking a deer might of had only a one year statue of limitations. But what about waste not want not, or do the statue of limitations run out because he was currently trying to sell copies of illegally taken deer. I know the most the fines probably could of been is around 1000 dollars or 90 days, but at least the idiot had to suffer. But I am glad that the court ruled on the law and not the case.

good ruling by the court. we need to protect our freedoms at all costs. bad acting by the "commander". in the words of master po: "such arrogance should never be tolerated".

I'm glad to see the supreme's court ruling, the "deer commander" is a disgrace, and I don't feel the least bit sorry for his "financial" problems related to his legal defense.

Buckhunter is right that the anti's are to blame for this. The Court had no choice but to strike down the law because the stated purpose was to outlaw "crush videos" and the law was written to outlaw any video depicting animal cruelty with no standard to define cruelty. That's no accident--they wrote it that way to give the crazies more tools to use against us.

What ever loss he incurred was too little for justice. I feel he should at least get a substantial probation. I'm sure he'll be watched by all that know him, still not enough for blatant game theft and to try to profit from the sale of the ilegal videos. Yes he'll get his in the end, called karma!

I've lived in places where the locals would vandalize his property until he found another place to live.

Somebody told me that the insurance companies will not pay the second time your house burns down.
